1         General Information

3         Identification of the Data Protection Officer

Pursuant to Article 37 of EU Regulation 679/2016 on the protection of personal data, no Data Protection Officer has been appointed.

4         Types of data processed
4.1        Browsing data

The IT systems and software procedures used to operate this website acquire, during normal operation, certain personal data which is then implicitly transmitted through the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes:

  • the IP addresses or domain names of the computers used by users connecting to the site;
  • the URI (Uniform Resource Identifier) addresses of the resources requested;
  • the time of the request;
  • the method used to submit the request to the server;
  • the size of the file obtained in response;
  • the numerical code indicating the status of the response given by the server (e.g. successful, error, etc.)
  • other parameters relating to the user’s operating system and IT environment.

This data is used solely to obtain anonymous statistical information on the use of the website and to check its correct functioning. The data in question is deleted immediately after processing. The data may be used to ascertain liability in the event of hypothetical computer crimes against the site: apart from this eventuality, web log data is not retained for more than 24 months.

4.3        Email addresses

Should users/visitors, when accessing this website, submit their personal data to access certain services or to make enquiries via email, this entails the Company acquiring the sender’s email address and/or any other personal data, which will be processed exclusively for the purposes set out in this statement. Your data will be processed for purposes related to the fulfilment of your specific requests, contractual, tax and accounting obligations; billing history; litigation and credit protection; and compliance with obligations under applicable laws.

4.4        UniShop Section

The website offers B2B users the option to visit www.unishop.it to proceed directly with the purchase of the products sold on that site. To this end, the user is required to provide the following details, failing which they will be excluded from the online sales service: full personal details necessary for the processing of the order. The purchase is also subject to the express acceptance of the Privacy Policy, by ticking the box provided.

4.5        Contact Section

The “Contact” section of the website allows the user, via the relevant form provided, to send the Company a personal message in order to receive a reply from the Company. The following personal data is required:

  • First name
  • Surname
  • Email address
  • Company
  • Address (optional)
  • Telephone

Acceptance of the Company’s Privacy Policy is an essential requirement for using the service in question.

5         Purpose of processing

Personal data may be processed for the following purposes:

A1) to meet pre-contractual requirements (e.g. processing of quotations or orders, credit checks); to fulfil legal and contractual obligations (e.g. bookkeeping, tax formalities, administrative management); customer management; credit management; risk control (fraud, insolvency, etc.); dispute resolution and debt collection; accounting and treasury management; financial services instrumental to customer management; management of electronic payment instruments; insurance services instrumental to customer management; warehouse and transport management; management of the commercial relationship.

A2) Sending commercial communications and informational/promotional material and newsletters, direct sales, carrying out other marketing initiatives, including any promotions and offers, satisfaction surveys, conducting market research and statistics. Communications for the purposes indicated above may be sent either via traditional contact methods, such as post or calls via an operator, or via automated communication methods, such as email, SMS, MMS, WhatsApp and telephone calls.

Within the scope of marketing purposes, data may also be processed for so-called “customer care” activities, such as offering products specifically selected for the Customer, and verifying Customer satisfaction in relation to the products and services offered.

A3) Purposes related to the provision of services and/or products offered by the Website: by way of example only, to provide the services and/or products requested by the User; to enable participation in activities promoted by the Website; to manage registration on the Website; to respond to specific requests from the User; to comply with legal or contractual obligations. The provision of data for this purpose is necessary to use the requested services or to access the Website.

Through this website, the Company does not deliberately collect special categories of personal data (Art. 9 of EU Regulation 2016/679) or criminal data.

6         Consent, mandatory or optional nature of data provision and consequences

The provision of the Customer’s data is necessary for the purposes referred to in points A1) and A3) and does not require the Customer’s express consent. Any refusal by the Customer/User to provide personal data will make it impossible to fulfil requests, complete the order or use the website.

The Customer’s consent to the processing of their personal data for the purposes set out in point A2) is optional. Failure to consent to the processing of your personal data for the purposes set out in point A2) will mean that UNIFIX SWG S.r.l. will be unable to carry out the activities listed above (e.g. sending newsletters, promotional communications, offers, promotional activities, customer care, customer satisfaction surveys, etc.).

7         Disclosure to third parties

In order to enable the fulfilment of the purposes referred to in point A), the relevant data concerning you:

  1. may be made available to those acting under the Company’s authority as data processors who need to process such data in order to carry out their duties or by virtue of the position they hold. These data processors, whose number will be kept to a minimum, will have access only to data relevant to the tasks assigned to them and will act in accordance with instructions provided by the Company.
  2. may be made available to other companies within the Group, suppliers and other external parties to enable the Company to contact them or be contacted, to carry out its business activities, including during the pre-contractual phase, and to fulfil obligations arising from contracts, as well as to third parties to whom it is necessary to disclose them in order to fulfil obligations arising from a contract to which you are a party or to comply with a request made by you (e.g. transport providers, professional firms, credit institutions, insurance companies, telecommunications operators, advertising support and consultancy firms, etc.);
  3. the Company uses other businesses and individuals to carry out specific activities such as sending emails, delivering parcels and processing payments. These parties have access only to the personal data strictly necessary to perform their tasks. The Company emphasises that they are prohibited from using such data for any other purpose and are obliged to process it in accordance with this Policy and applicable legislation.
  4. Any information concerning you may be accessible to the professionals whom the Company has identified on an individual basis and whom it has expressly designated as System Administrators. These are technical staff whose activities are aimed at managing and maintaining the Company’s website, applications and IT infrastructure (e.g. overseeing the resources of a computer’s operating system or a database system and enabling their use, managing access credentials, organising network flows, performing backups, implementing security measures, etc.);
  5. Your data will not be disclosed, meaning that it will not be made available to unspecified parties and will not be transferred outside the European Union or to an international organisation.
8         Data retention

Data may be processed with or without the aid of electronic tools, provided that appropriate procedures and systems are in place to guarantee the data subject’s rights, as well as the security and confidentiality of the information, in accordance with the provisions of the legislation.

The information and personal data of users collected, including data freely provided for the purpose of receiving advertising material or other communications, will be retained solely for the purpose of providing the requested service and for the duration necessary for that purpose.

Therefore, all personal data processed for the purposes set out in point A1) will be deleted after 5 years, once the service has been completed, provided there are no further interactions.

For the purposes referred to in point A2), personal data will be retained until a request for deletion is made by the data subject, who has the right to withdraw consent at any time via the dedicated link provided in communications.

The retention periods set out may be subject to change in the event of a different request from the authorities or following retention requirements established by law (for example, 10 years for the tax retention of documents).

9         Exercise of the data subject’s rights

Pursuant to Articles 13, 14 and 15 of Chapter III of EU Regulation 679/2016 on the protection of personal data, data subjects have the right at any time to obtain confirmation as to whether or not such data exists, to know its content and origin, to verify its accuracy, or to request that it be supplemented, updated or rectified.

Pursuant to Articles 16, 17 and 18 of Chapter III of EU Regulation 679/2016, they have the right to request the erasure, anonymisation or blocking of data processed in breach of the law, as well as to object, in any case, on legitimate grounds, to their processing. 10      Transfer of personal data to a third country or an international organisation

The data collected by UNIFIX SWG S.r.l. is not transferred to third countries outside the European Union or to international organisations.

11      Existence of automated decision-making (e.g. profiling) and the impact of such processing on the rights and freedoms of the data subject.

The data collected by UNIFIX SWG S.r.l. is not subject to profiling, i.e. automated processing carried out on personal data for the purpose of evaluating aspects of a natural person, in particular to analyse or predict aspects concerning that natural person’s professional performance, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

12      Data security

The Company protects personal data by applying internationally recognised security standards, as well as through security procedures that protect personal data:

  • from unauthorised access;
  • against misuse or disclosure;
  • from unauthorised alteration;
  • from accidental loss or destruction, or loss or destruction caused by unlawful acts.
13      Minors

The website “www.unifix.it” is not intended for use by minors, who are not authorised to make purchases via the sites listed. We understand the importance of protecting information relating to minors, particularly in an online environment, and therefore we do not deliberately collect or retain personal data relating to minors.
